Terms of Service

Welcome to LearnCoachAssist ("we", "us", "our"), the operator of learncoachassist.com (the "Service"). These Terms of Service ("Terms") form a binding agreement between you and LearnCoachAssist. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

1. The Service

LearnCoachAssist is a spaced-repetition flashcard study tool. The study product — decks, cards, the spaced-repetition scheduler (SRS), quizzes, and export — is always free. We monetize through advertising and paid subscription tiers that add AI-generation credits, remove ads, and enable private decks. Paid tiers do not restrict access to studying.

2. Accounts and registration

• You must be at least 16 years old to use the Service (or 13 in the United States, with parental consent where required).
• You are responsible for keeping your login credentials secure and for all activity under your account.
• You must provide accurate registration information and keep it up to date.
• One person per account unless you have our written permission otherwise.

3. AI-generated content

Some content on the Service is produced with the assistance of artificial intelligence:

• AI-generated decks — flashcards, overviews, and textbook-style material created on request from a topic, text, or PDF.
• Synthetic voice — text-to-speech audio (marked "Synthetic voice" on the Listen controls).

AI output can be inaccurate, incomplete, outdated, or otherwise unsuitable, and it may contain errors. Always review AI-generated material before relying on it, particularly for exams, certification, or professional purposes. Where the Service marks content as AI-generated, that marking is part of the content and you may not remove or obscure it. You may not present AI-generated output as human-authored work. When you use AI generation, we may send your topic and any material you provide to a third-party AI provider as described in our Privacy Policy.

4. Your content

• Deck content you create or upload remains yours. You grant us a limited, non-exclusive licence to store, process, and display it solely to operate the Service.
• You must own or have the right to use everything you upload, and you may not upload content that is unlawful, infringing, defamatory, harassing, or that discloses someone else's personal data without their consent.
• We may moderate AI-generated and user-uploaded content to protect the Service and its users, and may remove content that violates these Terms.

5. Subscriptions, AI credits, and payments

• Paid plans (e.g., Plus and Pro) provide AI-generation credits, an ad-free experience, and other features described on the pricing page. Prices and included credits may change with advance notice; active subscriptions keep their current terms until renewal.
• Payments are processed by our payment provider (e.g., Stripe). We do not store full card numbers.
• Subscriptions renew automatically until cancelled. You can cancel at any time from your account; access continues until the end of the paid period.
• AI credits are consumption-based and are not refundable or exchangeable for cash.
• Refunds for accidental or erroneous charges are considered on request within 14 days of payment.

6. Acceptable use

You agree not to misuse the Service, including: attempting to disrupt or overload the Service; scraping or bulk-exporting content beyond normal study use; creating accounts or generating content at scale to abuse AI credits; reverse-engineering the Service; or using the Service for any unlawful purpose.

7. Intellectual property

The Service, its software, design, trademarks, and non-user content (including AI-generation templates) are owned by LearnCoachAssist or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the Service for its intended study purpose. Nothing in these Terms transfers ownership of the Service to you.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that study materials (including AI-generated ones) are accurate, complete, or suitable for any particular exam or purpose. LearnCoachAssist is an educational tool, not licensed academic, medical, financial, or legal advice.

9. Limitation of liability

To the maximum extent permitted by law, LearnCoachAssist shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

You may stop using the Service at any time and delete your account from your account settings. We may suspend or terminate access to the Service (including AI-generation features) if we reasonably believe you have violated these Terms, if required by law, or to protect the Service or other users. You can request account deletion at any time; our Privacy Policy describes what we delete and when.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where reasonably practicable, notify you (for example, by email or a notice in the Service). Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Croatia, without regard to conflict-of-law rules. If you are a consumer in the European Economic Area or the United Kingdom, you also retain any mandatory protections of the law of your country of residence. We will try to resolve any dispute informally first — contact us and we will work with you in good faith.
